The fine print.
Clear policies, written like grown-ups talking to grown-ups. Everything here is meant to protect both sides of the partnership and set honest expectations from day one.
Privacy Policy
3rd Grade Digital respects your privacy. This policy explains what information we collect, why we collect it, and how we handle it. We collect only what we need to do good work and stay in touch with you.
What we collect
When you contact us, take the Pop Quiz, or become a client, we collect the information you choose to give us: your name, email, business details, and anything you share about your goals. When you visit the site, we collect standard analytics data such as pages viewed and general location, the same as most websites.
How we use it
- To respond to you and provide the work you hired us for
- To send you updates related to your project or Program
- To improve the site and understand what is useful
- To meet our legal and accounting obligations
What we do not do
We do not sell your information. We do not share it with third parties except the trusted tools we use to run the business, such as our hosting, email, and analytics providers, and only as needed to serve you. You can ask us what we hold about you, and ask us to correct or delete it, at any time.
Cookies. The site uses standard cookies for analytics and basic functionality. You can control cookies through your browser settings.
Terms of Service
By using this website and engaging 3rd Grade Digital, you agree to these terms. They are written to keep the relationship clear and fair for both sides.
Using this site
The content on this site, including copy, design, and our frameworks, belongs to 3rd Grade Digital. You are welcome to read it, share links to it, and use it to decide whether to work with us. You may not copy, republish, or resell it as your own.
Engaging our services
Work begins once a proposal and Statement of Work are signed and any required deposit is received. The specific scope, deliverables, timeline, and fees for your engagement are defined in that signed agreement, which takes precedence over anything described generally on this website.
The agreement governs. Pricing and packages shown on this site are starting points. Your actual terms live in your signed Statement of Work.
Project and Payment Terms
Every engagement runs on a written agreement. Rather than publish specific figures here, we keep the exact terms in your Statement of Work, where they can be tailored to the work. Here is how we operate in general.
Deposits and billing
Builds typically begin with a deposit, with the balance billed against milestones. Programs are billed monthly. Dissertation is billed annually, with payment plans available. The specific amounts, schedule, and any payment plan terms are set out in your signed agreement.
Scope and revisions
Each engagement includes a defined scope and a set number of revision rounds, named in your agreement. Work beyond that scope is welcome, and we will quote it before starting so there are no surprises on an invoice.
Timelines
We commit to realistic timelines and we hold to them, provided we receive the content, feedback, and approvals we need on time. Delays in those inputs move the timeline accordingly.
No hidden fees. You will always know what something costs before we do the work. We quote overages in advance, every time.
Intellectual Property
What you own
On full payment, you own the final deliverables we create specifically for you: your website, your content, and the brand assets produced for your project. They are yours to use, keep, and build on.
What we own
3rd Grade Digital retains ownership of its own methods, frameworks, templates, and tools, including The Syllabus and the seven Pulse framework, our internal processes, and any reusable code or systems we bring to the work. Using these to serve you does not transfer them to you.
Portfolio rights
Unless we agree otherwise in writing, we may show the work we did for you in our portfolio and case studies, including in the Yearbook. If your work is sensitive and you would prefer we keep it private, tell us and we will honor that.
Confidentiality
We treat your business information as confidential. Anything you share with us that is not public, your numbers, your strategy, your plans, stays between us and is used only to do the work. We expect the same care with anything we share with you, including our frameworks and pricing.
This commitment continues after the engagement ends. Confidential information stays confidential.
Cancellation and Refunds
Programs
Programs are month to month and can be paused or cancelled with thirty days written notice. There are no cancellation fees and no auto-renewing traps. Your final month is run with the same care as your first.
Builds
If a Build is cancelled partway through, you are billed for the work completed to that point, and you receive the work produced so far. Deposits cover work already scheduled and begun, so they are generally non-refundable once a project has started.
Dissertation
Dissertation is a twelve month commitment from both sides. Cancellation terms for the annual engagement are set out in that specific agreement, given the depth and the limited number of spots.
Limitation of Liability
We do careful, professional work and we stand behind it. That said, we cannot guarantee specific business outcomes such as exact traffic, ranking, or revenue numbers, because those depend on many factors outside our control.
To the extent the law allows, our total liability for any claim related to our work is limited to the amount you paid us for the work in question. We are not liable for indirect or consequential losses.
Governing Law
These terms are governed by the laws of the State of Illinois, United States, where 3rd Grade Digital is based. Any dispute will be handled in good faith first through direct conversation, because that is how we prefer to solve things, and through the appropriate courts of Illinois if it cannot be resolved that way.
Questions about any of this? Reach out before you sign anything. We are happy to walk through any term in plain language.
Ask us anything.
If something here is unclear, or you want a term explained before you sign, we would rather talk it through than have you guess.
